(6)What is "Floating Charge"?
A Floating Charge is a security interest (charge) created by a company in favour of a lender over a class of assets that fluctuates in the ordinary course of business — such as inventory, trade receivables, or cash. Unlike a fixed charge (which attaches to specific, identifiable assets), a floating charge "hovers" over the changing pool of assets and permits the company to deal with those assets freely until a crystallisation event occurs (e.g., default, appointment of receiver), at which point the floating charge converts into a fixed charge on the assets then held by the company. Governed by Sections 77–87 of the Companies Act, 2013 and must be registered with the RoC within 30 days of creation.
